TERMS OF REFERENCE FOR CONSULTANCY Services: Upgrading & Developing the existing ELECTRONIC CASE MANAGEMENT SYSTEM AT THE SUPREME COURT, BENADIR REGIOANAL AND APPEAL COURTS AND DEVELOP BASIC ELECTRONIC CASE MANAGEMENT SYSTEMS TO ALL (14) BENADIR DISTRICT COURTS OF MOGADISHU.
BACKGROUND
In 2018 with the support of the UN Joint Rule of Law Programme, a case management system has been implemented at the Supreme Court, Benadir Appeal Court and Benadir Regional Court. The case management system enabled the courts to streamline core functions for the courts including enabling the establishment of a mechanism for capturing, tracking, processing, and reporting on cases.  The system also have contributed to safeguarding the integrity of court case records and documents, and facilitated up to date tracking and gathering of information and events related to the status and progress of individual cases.
Through the case management system, the leadership of the judiciary fulfilled its responsibility of detecting delays and reducing the backlog of cases by holding responsible judges and prosecutors accountable. Crucially, the case management system increased the transparency of judicial processes and contributed to improving efficiency, integrity and public confidence in the court system.
Objectives of the Consultancy
The objective of this consultancy is to:

Undertake an assessment of the existing case management system at the Supreme Court, Benadir Appeal Court and Benadir Regional Court.
Upgrade and develop the existing case management system at the Supreme Court, Benadir Appeal Court and Benadir Regional Court.
Develop basic electronic case management systems to all (14) Benadir district courts of
Provide training to key staff at the Supreme Court, Benadir Appeal CourT, Benadir Regional Court and 14 district courts in Banadir region on how to use the system.

System Overview
The current offline case management generally connotes the entire set of actions that a court takes to monitor and Control the progress of a case. The case started from the Benadir regional courts, and goes through appeal court and the Supreme Court. While the three courts have different users, however, the system is connected and integrated and it has one server at the Supreme Court. The current system provides the basics for case registrations, case tracking, and capacity to upload case related documents. However, it lacks a number of key functionalities and needs upgrading to include other administrative related functionalities.
Your proposed system should:
Activity One: Upgrading the existing case management system.

Simplify the digital process of cases between Regional Court, Appeal Court and Supreme Court.
Add other digital Boards to the current system to show the appointments of the cases for each court.
Developing of case information sharing protocols at the Supreme Court, Benadir Appeal Court & Benadir Regional courts.
Add digital Queue for Case Management to serve to the citizens as First in First out methodology.
Add human resource management for all courts to enhance the performance, including Biometric, attendance, appraisal, Leave and Trainings.
Allow Chief Justice to access and flow-up all cases for all court in single platform.
Upgrade the Local Area Network using CISCO devices for security and connectivity.
Generate detailed Statistics and data analysis is indispensable to strengthen the accessibility and integrity of the justice system.
Establish well equipped Server Center to facilitate the workflow and ICT needs for all courts.
Delivering any material and equipment required for upgrading this system.
Providing warranty, maintenance and training support.
Case Analytics and Reporting.

 Activity Two: Develop basic electronic case management systems to all (14) Benadir district courts of Mogadishu.

Develop case management system throughout 14 Districts in Banadir Region.
Create a Centralized Database for Electronic Case Management System
Developing of case information sharing protocols throughout 14 Districts in Banadir Region.
Allow Chief Justice to access and flow-up all cases for all court in single platform.
Construct updated Local Area Network using CISCO devices which connect all district courts with reliable security and connectivity.
Interconnected Electronic Case Management System for 14 Districts in Banadir Region
Building a highly Secured Network infrastructure for all 14 Districts.
Delivering any material and equipment required for upgrading this system.
Providing warranty, maintenance and training support.
Case Analytics and Reporting.

The key results and deliverables expected from the consultant/firm and the payment conditions are indicated below:

1.      A new upgraded electronic case management system for capturing, tracking, processing, and reporting on cases developed for the Supreme Court, Benadir Appeal Court and Benadir Regional Court.

Provide training to key staff at the Supreme Court, Benadir Appeal Court, Benadir Regional Court and 14 district courts in Banadir region on how to use the system.

 Submission Requirements
Interested consultancy firms/companies shall submit the following documentations:

Registration certificate of the firm.
Profile with the organizational structure and CVs of key personnel
Proof of relevant experience.
A proposal with technical and financial aspects.

Evaluation Criteria

Quality of the technical and financial proposal
Experience and track record including successful completion of past assignments.
Legal documentations including registration certificate
Willingness and flexibility to work within the required deadline.
